No drugs involved

The two men charged in last month's triple slaying in Cheshire had no drugs or alcohol in their systems, a startling revelation that could damage their chances of escaping death sentences.Sources familiar with the investigation said toxicology tests on both Joshua Komisarjevsky and Steven Hayes came back negative for drugs or alcohol. Even if they had been drunk or high on drugs, it would not have been a legal defense. Juries generally hold criminals fully responsible for their crimes even if they are on drugs. They shouldn't have taken drugs in the first place.

This case has malicious premeditation written all over it. It's a prosecutor's dream case. No lack of evidence, no need to plea bargain. The only thing lacking is a fast appeals process to carry out the capital sentence.

Many times in criminal cases drug use is used as a mitigating circumstance. It can't be used in this case and I for one am very glad they were drug and alcohol free.
