Public hearing closing

It was quite a meeting last night... when I left my house at 9pm, I was actually wondering if I'd get there in time to speak. ha! anyway... some thoughts...

1) I got there and the first thing I was told was the outgoing PZC Chair Patti Flynn Harris kicked off the meeting with a Freudian slip, commenting "when we approve this..." er, uh... "if we approve this...." ha! Again though, I showed up late so don't know if it's true. Nonetheless, I just had to mention it cuz it was too funny to pass by... seriously though, can anyone confirm if she said that?

2) There's been a lot of discussion about whether this proposal will be the tipping point in moving from a volunteer FD to a paid FD. And that seemed to be refuted, but we should all keep in mind that a paid FD (more precisely, two paid firemen) was on the Council's agenda just over two years ago. It disappeared without much fanfare, but it did get on the agenda once already.

3) I think of most concern to me was the fiscal impact analysis' revenue assumption for building inspection fees:

This concerned me because while the Town Manager presented this revenue of $1.16 million (with offsetting costs of approximately $100k), he didn't mention that in CT, it is basically illegal for towns to "turn a profit" in a municipal building department. In other words, building department revenues cannot exceed building department expenses... or at least that's what the Council has been told for each of the past four years whenever we've discussed the building department fees. And when I asked for clarification... perhaps I missed it, but I didn't hear anything about the law changing. So I'm still wondering... is this "million dollar windfall" for real? Or will the town approve this project, get paid these fees, then get sued by the developer and refund this $1,000,000? I don't know, but I know the Town Manager has testified with some very contradictory information.

I guess I shouldn't be too surprised though... from the continued claims that defined contribution plans don't really work for volunteers to the pool with its 40,000 annual users and $1,400 profit... I think I may need to start directing all my financial questions to our Finance Director, Patti Lynn Ryan.

4) As the clock ticked away and 2am arrived, I finally got a chance to talk. (Btw, while I was annoyed at the late hour... I don't fault PFH. It was a judgement call with good intentions... people were there and she wanted to let us speak. Unfortunately, she couldn't foresee just how long comments would take.) My early morning comments...

a) I drew attention to the flooding problems related to the 129' vs 137' floodplain elevation... including asking the PZC to ensure that no government agencies ask the town to return the $280,000 that passed thru the town on the way to remediating the collapsing aqueduct.

b) I asked if the proposal was energy independent... and keeping in mind that I was pretty groggy at this point... I think the answer was no, though the developer is looking for state and federal funding for some alternative energy projects that may alleviate their drain on the grid. And if I got this right, then this answer was unacceptable... I mean, at what point will we start taking our energy issues seriously?

c) I pointed out that this proposal was sprawl and should be rejected as presented. While there's no need for the residential, if it is included it should be above the retail and the impervious surfaces should be reduced while conservation easements should be placed on much of the land.

Again, it's a late night... so signing off with a thank you to Chiefs Cruess and Casner. I thought Mike and Jack did a really good job in compiling the information and explaining their thoughts.

You point regarding building fees is very legitimate. The TM was dancing around the question of how he might justify such fees, but bottom line, I do not think the town will ever see those fees (in that amount).

This calls for some thoughts by our resident CPA.

What is confusing is both chiefs said that W/S is the tipping point for more services.

Some questions would be.

1. How many residential calls are made by each of the departments? How many calls are made by the commercial. And what is the square footage of each.

2. Have the current resources been sufficient to cover the NE.

3. The TM indicated that he knew of other new proposals for the NE.
What are they and what are their square footage?. Are any of these other projects in any of the other NE interchange quadrants?

4. If the W/S proposal were not on the table, it would not be the tipping point. Based on this assumption, when in the future would there be a new tipping point, without W/S. So, instead of only allocating a portion of the costs from year one to other development, W/S should be the cause of 100% until the tipping point is reached, based on W/S development not happening. Isn't that the right way to project cost. This would show a lower return to the town in the earlier period.

One could watch the tape as see if PFH did slip. Another note the 1 &1/2% fee that realtors are so mad about could go away in the future if not voted on again by the state. This was omitted by the TM. It's a one time fee paid to the town by the buyers at closing. I'm not sure what the exact amount (around $700,000) was but that should be factored in.

Mr. Cobern asked "is there ever a net-negative to the town?" What a question. The town has a net positive now as long as the owners pay ther taxes. But wait, the town just paid some $200,000 + to build a by-pass. The taxes I'm sure are not $200,000/year. So, Mr. Cobern we have our first net-negative year with many to follow is this is appproved.

The review of W/S's impact study was a joke. What staff person is going to go against their boss, the TM. There appears to be a high level of fear among town employees and as a result they are afraid to voice their opinions on almost anything.

The one person who's budget will be affected the most did not attend. Why wasn't Florio there? Most likely he didn't want to publicly be a party to the ridiculous estimate of only 11 students.

It was very interesting that right after Milone got through his review, he started to backoff from his estimate by saying it is only an estimate and if in the future anything was needed he and Florio would go to the Town Council to get it. He, Florio and everyone else in town knows 11 students is ridiculous. Don't be surprised if there are more than 120 more students and that is possible.

Boy what a spirited discussion we have had about this issue. This is democracy in action and at its best!
I am hopeful that this project has got alot of people involved that may not have been before. We can all come together even if it is built and do what is right for Cheshire!

It's time to get the developers out of town government. Cheshire should be run for the people and not the special interests.

For a start, get Paul Bowman off the nominating committee of the Republican party.

Did you read the editorial by James Fazzone, looking for the silent majority who oppose the Mall? He states everyone he speaks with is in support, not a surprise. He only speaks to people that agree with him, people that will benefit from the Mall. Those that oppose choose not to speak with him. He is seen as one main character that has sold out the town through changing regulations to suit the developers.

11:18AM If you really want the best thing for Cheshire - we shouldn't build it. From an environmental standpoint this is a disaster. From a traffic standpoint this is a disaster. From a police, fire & school standpoint this is a disaster. Need I say more? We have more places to shop than money to spend why spoil Cheshire?

Yes indeed that is right let us strive to make our town friendly and one where we can live in peace and harmony-even if the lifestyle center gets built that does not mean we have to be cruel or insulting to eachother.We can all live as brothers and sisters in our town and respect eachother and send eachother nice Christmascards.
